Who is Guilty?

People compete in a conflict to bring proofs that they are innocent and the others are guilty. The whole idea of proving who is guilty and who is innocent came from both: Justice and the game of human rights respect. In any legal procedure one must prove that s/he is the victim in order to prove innocence.  In other procedures such as the human rights case in a conflict for example usually both sides race to prove that they suffer from the other side by using media, convincing their selves that they are right no matter what, and use their claim to be protected by the international community and associations.

The whole idea of going through what is considered pain and suffering that those people agree to live again only to prove that they are right is strange. Since pain and suffering is made by humans and also considered a hard thing to go through, it is strange to see the ability of those people to go through it a thousand times only to satisfy their ego in proving for their selves and others that they are victims and their actions are legitimate.

Using this ability and courage to live again the hard stories that one goes through, in finding a solution for a conflict or even an individual problem can be more creative than spending this energy in convincing others that one is right.  The proof of being on the right side cannot be bought although the international community and people in certain communities are influenced by the media or the way one uses feelings to leave an impression that is fake.

The answer for such a question could be that no one is innocent or guilty. The system that people follow to reach a conclusion in this matter could be inappropriate since beliefs, systems, and laws differ from one country to another and even from one person’s mind to another.

Someone may say that humans since the time of the Greeks until today spent thousands of years to create an international law that is appropriate to deal with such cases, but did they ask themselves whether all the countries in the world commit to this law? And what if this law is only used once a weak country or minority is under judgment?

It is right that we hold a great law and system that we created as humans through history, but the fact is that this law is used differently and manipulated from time to time to fulfill the desire and interests of the hegemony that controls in every part of history.

    Ziad,

    You raise a very interesting and complicated question and I honestly think that for certain acts there is no answer to this. It also brings to mind the issue of one man’s terrorist being another mans freedom fighter.

    The legal system, be it in a specific country or one that is international such as the UN, is a highly debatable topic and all people who formulate such laws need to change them as the times change. For example look at the laws that govern the UN system, a good 80 percent of them are defunt and reflect the world of the 1950’s, what good is that to us today in 2008?

    In some cases your right, no one is guilty. HOw can you hold a child of 10 or even 15 or 20 guilty of weilding a gun when that is all he knows?

    Laws are uselss if they dont reflect the changing times, the people of today and are progressive in nature.
